1. Definitions

• "Panelist" refers to individuals who register to participate in surveys and research activities.

2. Panelist Terms

2.1. Eligibility

To register as a panelist, you must:

• Be at least 18 years of age
• Provide accurate and complete information during registration
• Have a valid email address and phone number
• Reside in an African country where we operate

2.2. Account Responsibilities

As a panelist, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Updating your profile information to ensure it remains accurate
• Notifying us immediately of any unauthorized use of your account

2.3. Survey Participation

When participating in surveys:

• You agree to provide honest, thoughtful responses
• You will not use automated means to complete surveys
• You will not attempt to participate in surveys for which you are not eligible
• You will complete surveys within the specified timeframe

2.4. Rewards

Regarding panelist rewards:

• Rewards are issued only for fully completed surveys that pass quality checks
• Reward amounts vary by survey and are clearly disclosed before participation
• Minimum withdrawal thresholds may apply
• We reserve the right to modify the reward system with notice
• Fraudulent activity will result in forfeiture of rewards and account termination

3. Client Terms

3.1. Service Agreement

Clients engaging our services agree to:

• Provide clear specifications for research requirements
• Use the collected data in compliance with applicable laws
• Make payments according to the agreed schedule
• Maintain confidentiality of proprietary methodologies and processes

3.2. Data Usage

Regarding data provided to clients:

• Clients receive anonymized, aggregated data unless otherwise specified
• Clients must use data in compliance with data protection regulations
• Clients may not attempt to re-identify respondents from anonymized data
• Data may only be used for the specified research purpose

4. Intellectual Property

The content on our website and platform, including text, graphics, logos, and software, is the property of Africa Surveys and is protected by copyright and other intellectual property laws.

Clients retain ownership of their proprietary survey questions and research design. The Company retains ownership of aggregated, anonymized data and research methodologies.

5. Prohibited Activities

Users of our services shall not:

• Use our services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of our platform
• Interfere with or disrupt the integrity or performance of our services
• Collect or harvest any information from our platform without authorization
• Impersonate any person or entity or provide false information
• Engage in any activity that could damage, disable, or overburden our systems

6. Limitation of Liability

To the maximum extent permitted by law, Africa Surveys shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

We do not warrant that our services will be uninterrupted, secure, or error-free. We are not responsible for the accuracy of any data provided by survey respondents.

7. Termination

We reserve the right to terminate or suspend your account and access to our services, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through our website or by sending an email to registered users.

Your continued use of our services following the posting of revised Terms means you accept and agree to the changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
